Can You Sell a House With Violations or Permit Issues? Yes…You Can!

If you’re reading this, there’s a good chance your property has a problem. Maybe you found out there’s an open permit. Maybe there are violations you didn’t even know existed. Maybe the work was done years ago and now it’s coming back to you.


I want to be very clear about something right from the start. You are not stuck. You do have options. And yes, you can sell.


I’ve worked with homeowners and investors all over Long Island who thought their situation was a dead end. In most cases, it wasn’t. It just needed the right approach.


What Does It Mean to Have Violations or Permit Issues?


In New York, especially on Long Island, this is more common than people think.


It can look like:


  • Open or expired permits

  • Work done without permits

  • Certificate of Occupancy issues

  • Illegal apartments or conversions

  • Decks, extensions, or finished basements that were never filed properly

Sometimes homeowners knew. Sometimes they didn’t. A lot of times it comes up when you try to sell.


Can You Still Sell? Yes. But How You Sell Matters.


There is no one-size-fits-all answer. Every property and every situation is different. But generally, you have three paths:


1. Fix Everything Before Selling

This means closing out permits, resolving violations, and bringing the property into full compliance. This can take time and money, but it can also open your buyer pool and potentially increase value.


2. Sell As-Is With Full Disclosure

In many cases, a property can be sold in its current condition. Buyers, especially investors or experienced purchasers, may be willing to take on the issues. Pricing and expectations need to reflect the condition.


3. Negotiate a Middle Ground

Sometimes a deal comes together where certain issues are addressed and others are negotiated through credits or terms. This requires strategy and strong communication between all parties.


Where Deals Usually Fall Apart


This is where experience matters.


I’ve seen deals fall apart because:


  • Issues were discovered too late

  • Sellers were not prepared

  • Buyers got nervous without proper guidance

  • Agents didn’t know how to position the property


When a situation gets complicated, it needs to be handled correctly from the beginning.

  • Positioning the property correctly in the market

Not every property is perfect. Not every situation is simple. That does not mean it cannot be sold.


The Most Important Thing You Can Do


Do not assume you are stuck.


I’ve spoken to many homeowners who waited months or years because they thought they had no options. In most cases, there was a path forward. It just needed to be laid out properly.


Before making any decisions, it’s worth having a conversation.


If your property has violations or permit issues, you are not alone. And more importantly, you are not out of options. Every situation can be evaluated. Every property has a path. The key is knowing how to approach it.
